Terms of Service

1. Platform Ownership

My Military HQ is independently owned and operated by knowology LLC. It is not a Keller Williams resource, product, or subsidiary. knowology LLC reserves all rights to the platform, its technology, its data, and its systems. knowology LLC reserves the sole right to grant, restrict, or revoke access to the platform and all associated community resources at any time, for any reason, at its sole discretion.

"The Community" refers to the community of members operating on the My Military HQ platform — Keller Williams agents with military connections and their affiliated professionals.

2. Community Structure

The My Military HQ platform is operated by knowology LLC. The Community operating on the platform is led by a designated Community Leader, who sets Community standards and holds authority over Community membership, representation, and conduct. Members access the platform and participate in the Community subject to these Terms and any additional standards established by the Community Leader.

References in these Terms to "the Community Leader" mean the formally designated leader of the Community and any individuals they have formally authorized to act on the Community's behalf. References to "knowology LLC" mean the platform operator. Certain enforcement authorities under these Terms are held by knowology LLC, others by the Community Leader, and some by both, as indicated in the relevant sections.

3. Community Representation & External Engagements

Representation of the Community, its leadership, its members, or its network in any external setting — including external programs, partnerships, recorded calls, meetings, presentations, or marketing materials — is reserved exclusively to the Community Leader or those the Community Leader has formally designated. No member holds representational authority by virtue of membership alone.

Members may not use the Community, the Community Leader, its network, its data, or its systems as credibility, leverage, or positioning in external conversations, programs, or opportunities without prior written approval from the Community Leader.

Members may not initiate, propose, discuss, facilitate, or participate in any external partnership, collaboration, or opportunity involving the Community without prior written approval from the Community Leader. Any external conversation involving the Community must be directed back to the Community Leader.

Members may not act as intermediaries, representatives, or connectors on behalf of the Community in any external setting.

4. Network & Technology Protection

The platform, its systems, its technology, automation, AI capabilities, and underlying data architecture are the exclusive property of knowology LLC. The Community's strategy, roadmap, internal communications, leadership discussions, and member information are confidential to the Community and its Leader.

Members may not:

• Use the Community or its members as a source of leads, recruiting, or funnel redirection for external programs or organizations
• Position the Community or its network as a pipeline, access point, or resource for any outside organization
• Extract, export, or leverage member data or relationships for use outside the Community
• Promote or link to external funnels, programs, or booking systems that operate outside the Community ecosystem
• Replicate, reverse-engineer, or distribute any part of the platform's systems, workflows, or technology
• Share access credentials, internal tools, or proprietary resources with non-members
• Recruit members into competing communities, programs, or brokerages

Nothing in this section restricts legitimate member-to-member business activity, referrals, collaborations, or co-marketing that occurs within the Community ecosystem and does not position the Community, the Community Leader, or its systems as resources for external organizations.

Any attempt to redirect members, relationships, or opportunities outside of the Community ecosystem is considered a direct violation of these terms.

Members may not circumvent these Terms by acting through third parties, indirect communication, or alternative platforms to achieve outcomes that would otherwise violate these Terms.

5. Confidentiality

Information shared within the Community — including strategy, operational details, member data, leadership discussions, and internal communications — is confidential. Members may not share, disclose, or reference Community assets, strategies, or internal information in external settings without formal written approval from the Community Leader.

This includes verbal, written, recorded, or digital communication shared in calls, meetings, chats, or platform interactions.

This includes but is not limited to: Community strategy and roadmaps, member lists and contact information, internal training materials, leadership meeting content, and financial or operational data.

6. Member Conduct

Members are expected to conduct themselves professionally and in a manner that reflects the values of the Community. The following conduct is strictly prohibited:

• Harassment, bullying, threats, or discriminatory behavior toward any member, leader, or guest
• Impersonation or misrepresentation of credentials, military service, licensure, or community role
• Unauthorized recording, screenshotting, or distribution of Community calls, meetings, or platform content without express consent from the Community Leader, except where required by law
• Spam, unsolicited solicitation, or promotion of external programs, services, or businesses to other members
• Using the member directory, map, or any platform feature to harvest contacts or data for purposes outside of legitimate Community engagement
• Using automated tools, bots, or scrapers to extract member data or platform content
• Posting, uploading, or sharing content that is defamatory, obscene, or infringes on the intellectual property rights of others
• Attempting to recruit members into competing communities, programs, or ecosystems
• Using membership in the Community to imply authority, endorsement, or official standing beyond your actual role

Members are responsible for all activity that occurs under their account. Sharing login credentials or allowing unauthorized access to the platform through your account is a violation of these terms.

Members are expected to report known or suspected violations of these terms to the Community Leader promptly.

7. User Content & Intellectual Property

Members retain ownership of content they upload to the platform, including profile information, photos, and biographical details. By uploading content, you grant knowology LLC a non-exclusive, royalty-free, worldwide license to display, store, and use that content solely for the purpose of operating the My Military HQ platform and member directory.

This license does not grant knowology LLC the right to sell your content to third parties or use your name, photo, or likeness in external marketing without your explicit written consent.

You represent and warrant that any content you upload does not infringe on the intellectual property, privacy, or publicity rights of any third party. If knowology LLC receives a claim that your content infringes on a third party's rights, it may remove the content without notice.

knowology LLC reserves the right to remove or modify any content that violates these Terms or does not align with Community standards, without prior notice.

Upon voluntary departure or account termination, your profile content may be removed or retained at the discretion of knowology LLC. If you wish to have your content deleted, you may submit a written request to knowology LLC.

8. Data Privacy

knowology LLC does not sell, rent, or share member data with third-party marketers or lead aggregators, and does not use member content or platform activity to train artificial intelligence or machine learning models.

knowology LLC collects and processes personal data necessary to operate the My Military HQ platform, including account information provided through Google OAuth, profile details you submit, and usage data generated through your interaction with the platform. Your data is used solely for operating and improving the platform.

Member identities, contact information, and location data displayed in the directory and map are visible only to authenticated members of the Community. knowology LLC will not share member data with commercial real estate platforms or third-party services without member consent, except as required by law. While knowology LLC uses reasonable measures to protect platform data, no system can guarantee absolute security.

9. Limitation of Liability

THE MY MILITARY HQ PLATFORM AND ALL ASSOCIATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

knowology LLC does not warrant the accuracy, completeness, or timeliness of member profiles, directory information, map data, or any content displayed on the platform. Members are responsible for independently verifying any information before relying on it.

To the fullest extent permitted by law, knowology LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the platform, including but not limited to loss of data, loss of business opportunities, or service interruptions.

10. Indemnification

You agree to defend, indemnify, and hold harmless knowology LLC (and its owners, officers, employees, and agents), the Community Leader, and anyone the Community Leader has formally authorized to act on the Community's behalf, from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorney's fees) arising out of or related to:

• Content you upload, post, or share on the platform, including profile information, photos, and communications
• Your violation of these Terms of Service
• Your violation of any third-party rights, including intellectual property, privacy, or publicity rights
• Any claim by a third party related to your conduct on the platform or at Community-sanctioned events

11. Copyright & DMCA

knowology LLC respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act (DMCA). If you believe that content on the platform infringes on your copyright, you may submit a written notice to support@knowology.ai including:

• Identification of the copyrighted work you believe has been infringed
• Identification of the content on the platform that you believe is infringing
• Your contact information (name, address, email, phone number)
• A statement that you have a good faith belief the use is not authorized by the copyright owner
• A statement under penalty of perjury that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner

knowology LLC will investigate valid claims and remove infringing content where appropriate.

12. Third-Party Services

The platform may contain links to or integrations with third-party services, including but not limited to Google Calendar, Google OAuth, and external websites. knowology LLC is not responsible for the content, availability, privacy practices, or accuracy of any third-party services.

Your use of third-party services is governed by their respective terms and policies. knowology LLC makes no warranties or representations regarding third-party services and shall not be liable for any damages arising from your use of them.

13. Enforcement & Account Termination

These Terms exist to protect Community integrity and member trust. They are enforced consistently by knowology LLC and the Community Leader, each within their respective areas of authority.

Platform-Level Enforcement

knowology LLC may suspend or terminate your access to the My Military HQ platform for violations involving platform systems, security, technical terms, or knowology LLC's proprietary technology. Platform-level enforcement is at the sole discretion of knowology LLC.

Community-Level Enforcement

The Community Leader may remove members from the Community for violations involving representation, conduct standards, community confidential information, or other matters affecting Community integrity. Community-level enforcement is at the sole discretion of the Community Leader.

Joint Authority

A decision by either knowology LLC or the Community Leader is independently sufficient to remove a member's access to the affected layer. Serious violations — including but not limited to unauthorized representation, network exploitation, confidentiality breaches, and lead diversion — may result in both platform termination and Community removal.

knowology LLC and the Community Leader will typically issue a warning for minor violations, though no warning is required. No escalation process or remediation period is guaranteed.

Upon termination, your right to access the platform and all Community resources ceases immediately. Any content you uploaded may be retained or removed at the discretion of knowology LLC.

Members whose accounts have been terminated may submit a written appeal within fourteen (14) days of termination. Platform-related appeals should be directed to knowology LLC; Community-related appeals should be directed to the Community Leader. Submission of an appeal does not guarantee review, response, or reinstatement. All decisions are final.

14. Modification of Terms

knowology LLC reserves the right to modify, update, or replace these Terms of Service at any time. For material changes, knowology LLC will provide at least thirty (30) days' notice before the updated terms take effect. Members will be required to review and re-accept the updated terms before continuing to access the platform.

Continued use of the platform after being presented with updated terms constitutes acceptance of those terms. If you do not agree with the updated terms, you must discontinue use of the platform.

15. Governing Law & Dispute Resolution

These Terms of Service and any disputes arising from your use of the platform shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these terms or the platform shall first be resolved through good faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, either party may pursue binding arbitration administered in accordance with the rules of the American Arbitration Association. The arbitration shall take place in the State of Texas.

You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against knowology LLC.

16. Eligibility

Membership in the Community is available to Keller Williams agents with military connections and their affiliated professionals. By creating an account, you represent that you are a licensed real estate professional in good standing and that any claimed military service or affiliation is accurate.

knowology LLC reserves the right to verify eligibility and to revoke access if any representation is found to be inaccurate.

17. Membership & Fees

Access to the My Military HQ platform is offered as a paid subscription. Subscription fees, billing frequency, and available tiers are disclosed at the time of signup and may be updated from time to time with notice as described in Section 14.

During the platform's initial launch period, knowology LLC may offer promotional access, trial periods, or complimentary memberships to select members. Any such access is offered at knowology LLC's sole discretion and does not create an entitlement to continued access on the same terms once the promotional period ends.

Subscriptions automatically renew at the end of each billing period unless cancelled by the member in advance. Members may cancel at any time through their account settings or by contacting support@knowology.ai. Cancellation takes effect at the end of the current billing period; fees already paid are non-refundable except where required by law.

Failure to pay subscription fees when due may result in suspension or termination of platform access. knowology LLC reserves the right to modify subscription pricing, tiers, or features with at least thirty (30) days' notice to affected members.

18. Relationship of Parties

Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between knowology LLC, the Community Leader, and any member. Members are independent parties and are solely responsible for their own business activities.

19. Force Majeure

knowology LLC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from events beyond its reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, cyberattacks, or other force majeure events.

20. Survival & Severability

The following sections survive termination of your account and these Terms of Service: Community Representation & External Engagements, Network & Technology Protection, Confidentiality, Limitation of Liability, Indemnification, Governing Law & Dispute Resolution, and any other provisions that by their nature are intended to survive.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and knowology LLC regarding your use of the My Military HQ platform.

21. Acceptance

By signing below, you acknowledge that you have read, understand, and agree to abide by these Terms of Service, including the subscription, billing, and cancellation terms set forth in Section 17, with respect to your access to the My Military HQ platform operated by knowology LLC and your participation in the Community led by the Community Leader. You also acknowledge the Key Community Rules presented alongside these Terms and understand that violation of those rules may result in immediate removal. You understand that continued access to the My Military HQ platform and Community resources is contingent upon compliance with these terms.
